Hiring in the UAE is not “at-will” in the Silicon Valley sense. Federal labour law (implemented through MOHRE for most private-sector mainland and many free-zone employees) sets defaults on contract type, notice, end-of-service benefits, and wage payment. Startups that copy US offer letters without UAE-specific clauses create expensive disputes. This guide explains what to negotiate before day one.

Limited vs unlimited contracts

Limited-term contracts end on a date or project milestone. Renewals have legal consequences if you keep renewing indefinitely — courts and MOHRE may treat long-renewed limited contracts as unlimited.

Unlimited contracts are the default mental model for core team: they run until terminated through notice or mutual agreement, with statutory protections.

Founders often use limited contracts for project contractors misclassified as staff — if someone works full-time hours, takes direction from your CEO, and uses your equipment, MOHRE may classify them as employees regardless of the label.

Practical rule: Core engineering, sales, and ops leads on unlimited (or properly structured) employment; genuine freelancers on separate service agreements reviewed by counsel.

Probation

Probation periods let either side separate with shorter notice if the contract and law align. You cannot use probation to avoid end-of-service accrual tricks that courts dislike.

During probation:

  • Document performance issues in writing.
  • Pay through WPS on schedule — late wages trigger complaints regardless of probation.
  • Do not withhold passports (illegal; also destroys culture).

If you extend probation beyond what the contract allows, you may reset rights employees did not expect.

The Wage Protection System requires eligible employers to pay salaries through approved channels. Founders discover this when a bank asks for WPS files before releasing payroll accounts.
